Counties with 75,000 or More Residents

If your county has 75,000 or more residents, you must follow the Uniform Residential Landlord and Tenant Act (URLTA). This law provides structured procedures for eviction, requiring landlords to give proper notice before taking legal action. Compliance with URLTA ensures a smooth and lawful eviction process.

Eviction Process in Smaller Counties

For counties with fewer than 75,000 residents, landlords must provide tenants with a written 30-day notice before initiating eviction proceedings. This notice informs the tenant of the outstanding rent and gives them time to vacate the property. If the tenant fails to leave within the notice period, the landlord can file an eviction action in General Sessions Court.

Legal Steps to Remove a Tenant

Once a case is filed, the court schedules a hearing to determine the outcome. If the tenant does not vacate the property or appeal the case, then the landlord can request the sheriff to physically remove the tenant.
