What Happens if I Die Without a Will?

Who inherits if you die without a will? If there is no will in place, Tennessee allows intestate succession. The court follows legal guidelines to distribute assets.

Spouse and No Children

If there is a spouse but no children, the spouse inherits everything. The process is straightforward and ensures the spouse receives full ownership.

No Spouse and Surviving Children

If there is no spouse and there are surviving children, the children inherit equally. Each child receives an equal portion of the estate. The court oversees asset distribution to prevent disputes.

Spouse and Children in Tennessee

If there is a spouse and children in Tennessee, the spouse receives either 1/3rd or a child’s equal share. For example, if there is one child, the spouse receives 50%. The law ensures fair division among surviving heirs.

Additional Provisions for the Surviving Spouse

However, the are additional provisions in place for the surviving spouse such as homestead allowance and personal property exemption.
